The need to discipline, counsel or terminate staff for poor performance is an area that most business owners and managers dread.
Unfortunately, we live in a litigious society and often terminated employees are very quick to take their ex-employers through a Fair Work litigation process. Unless proper protocols are followed end to end, this can be costly to employers.
Once businesses are served with a Fair Work Claim from an ex-employee, they get caught up in difficulty understanding the legislation and forget they too have rights which protect them as a business. Not having a good HR Representative often, leads to businesses handing over money when they do not need to, or paying Lawyers hefty fees when in fact they just need a good HR Representative.
